ОСОБЛИВОСТІ НОРМАТИВНО-ПРАВОВОГО РЕГУЛЮВАННЯ ВИРОБНИЦТВА БІОПАЛИВА В УКРАЇНІ

Анотація

У зв'язку з глобальними змінами клімату та підвищенням вартості традиційних енергоресурсів усі країни світу активно займаються розвитком альтернативної енергетики. Нормативно-правове регулювання виробництва та використання біопалива визначає є визначальним на шляху до розвитку ринку альтернативної енергетики у світі загалом та в Україні зокрема. У статті здійснено огляд міжнародних заходів та документів, пов'язаних з боротьбою зі змінами клімату, зменшенням викидів вуглекислого газу та стабілізації рівня підвищення середньої температури у світі. Значну увагу присвячено механізмам зниження викидів парникових газів. Проведено детальний аналіз інструментів стимулювання розвитку та використання поновлюваних джерел енергії країнами ЄС. Здійснено детальний аналіз нормативно-правового забезпечення галузі альтернативної енергетики в Україні, зокрема: визначено основні принципи державної політики у сфері альтернативних видів палива відповідно до Закону України "Про альтернативні види палива"; проаналізовано зобов'язання України відповідно до вимог ратифікації Кіотського протоколу; визначено напрямки реалізації проєктів згідно з міжнародною торгівлею квотами Кіотського протоколу в Україні. Надано детальну оцінку енергоємності ВВП України. Проаналізовано основні напрями концепції реалізації державної політики у сфері зміни клімату на період до 2030 року. Визначено етапи "Нової енергетичної стратегії України до 2035 року: Безпека, енергоефективність, конкурентоспроможність" у сфері енергозбереження та відновлюваної енергетики. Запропоновано заходи щодо стимулювання ринку біопалива в Україні

FEATURES OF THE REGULATORY LEGAL REGULATION OF BIOFUEL PRODUCTION IN UKRAINE

Summary

Climate change prevention has become a top priority for the international community. For decades, developed countries have been combining the efforts of the state and the private sector, creating additional mechanisms and tools to reduce greenhouse gas emissions. The basis of normative legal regulation of production and consumption of biofuels is formed by international and adopted by individual states normative and legislative acts regulating the behavior of economic agents — producers of raw materials, biofuels and consumers. In connection with global climate change and the increase in the cost of traditional energy resources, all countries of the world are actively engaged in the development of alternative energy. The legal regulation of the production and use of biofuels is decisive on the way to the development of the alternative energy market in the world in general, and in Ukraine in particular. An overview of international events and documents related to the fight against climate change, the reduction of carbon dioxide emissions and the stabilization of the level of increase in the average temperature in the world are analyzed in the article. Considerable attention is devoted to mechanisms for reducing greenhouse gas emissions. A detailed analysis of the instruments for stimulating the development and use of renewable energy sources by the EU countries has been carried out. A detailed analysis of the regulatory framework of the alternative energy industry in Ukraine was carried out, in particular: the main principles of state policy in the field of alternative fuels were determined in accordance with the Law of Ukraine "On alternative fuels"; Ukraine's obligations were analyzed in accordance with the requirements of the ratification of the Kyoto Protocol; directions for the implementation of projects on international trade in quotas of the Kyoto Protocol in Ukraine. Detailed assessment of the energy intensity of Ukraine's GDP is provided. The main directions of the concept of implementation of state policy in the field of climate change for the period up to 2030 and competitiveness "in the field of energy conservation and renewable energy are analyzes. Measures to stimulate the biofuel market in Ukraine are proposed.
