СТРУКТУРОВАНІ ФІНАНСИ ЯК ОКРЕМИЙ ЕЛЕМЕНТ ГЛОБАЛЬНОЇ ФІНАНСОВОЇ СИСТЕМИ

Анотація

У статті розглядаються форми та інструменти структурованих фінансів в ісламській фінансовій системі.
Ісламські фінанси — це спосіб ведення фінансової діяльності, який узгоджується з релігійними правилами ісламу. Особливістю є наявність ряду певних заборон, продиктованих положеннями ісламського права. Об'єктивні демографічні, політичні та економічні фактори зумовлюють зростаючу роль та вплив індустрії ісламських фінансів на регіональні фінансові ринки зокрема, та на міжнародні фінанси загалом, визначають актуальність подальших досліджень у цьому напрямі.
Ісламські фінансові продукти засновані на контрактах (мають контрактну форму) і можуть бути класифіковані в межах трьох широких категорій: а) інструменти, подібні борговому фінансуванню; інструменти фінансування в рамках Моделі спільної участі у прибутку та збитку; інструменти у вигляді надання фінансових послуг.
Ісламські фінанси є певною мірою результатом фінансового інжинірингу, намаганням надити ринку певні види фінансових послуг за допомогою фінансових інструментів, що не суперечать, як існуючому в мусульманській країні "світському" законодавству (заснованому на загальноприйнятій у світі нормативно-правовій базі), так й одночасно відповідають ісламським релігійним вимогам та заборонам. Ці заборони і принципи визначають специфічні форми фінансових відносин та інструменти їх реалізації.

STRUCTURED FINANCE AS A SEPARATE ELEMENT OF THE GLOBAL FINANCIAL SYSTEM

Summary

The article considers the forms and tools of structured finance in the Islamic financial system.
Islamic finance is a way of conducting financial activities that is consistent with religious rules of Islam. The peculiarity is — a number of certain prohibitions imposed by the provisions of Islamic law. Objective factors (demographic, political economic) cause an increasing role and influence of the industry over regional financial markets and international finance, and determine the relevance of further research in this area.
Today, Islamic finance has covered such commercial areas as the capital market, asset management, and insurance. This type of finance represents all segments of the modern financial market — in commercial banking, in equity and venture capital transactions, in trade financing, in insurance and even in financial risks hedging. Islamic financial products are contract-based (have a contractual form) and can be classified into three broad categories: a) instruments similar to debt financing; b) financing instruments under the Profit and Loss Sharing Model; instruments in the form of financial services.
Despite certain difficulties and obstacles to the development of Islamic finance industry, their volume has grown rapidly over the last decade, and their banking segment has become systemically important in a broad regional dimension. Currently, Islamic finance covers a wide range of services. However, banking business significantly outperforms all other types and as of 2019 accounts for about 80% of total Islamic financial assets. The second most important segment is sukuk securities market, which is an alternative to conventional bonds.
Islamic finance is, to some extent, the result of financial engineering, an attempt to provide the market with certain types of financial services through financial instruments that do not contradict both the existing "secular" legislation in a Muslim country (based on the world's legal framework) and at the same time, meet Islamic religious requirements and prohibitions. These prohibitions and principles define specific forms of financial relations and tools for their implementation.
