УПРАВЛІННЯ ЗЕМЕЛЬНИМИ РЕСУРСАМИ УКРАЇНИ: МИНУЛЕ ТА МАЙБУТНЄ

Анотація

Завдяки використанню принципів методології єдності історичного та логічного, макроекономічного та інституціонального аналізу факторів виробництва розкрито теоретичну обмеженість та практичну неспроможність запровадження "ринку землі" в Україні. Обгрунтовано парадигму управління землями сільськогосподарського призначення, що підтверджується компаративним аналізом світових практик та сучасних глобальних тенденцій загостренням міжкраїнової конкурентної боротьби за всі види ресурсів. Доведено, що земля як фактор виробництва і як товар характеризується наступними специфічними властивостями в порівнянні з іншими товарами: тенденціями зменшення обсягів пропозиції та катастрофічним зростанням попиту, невідновленістю, неможливістю переміщення в просторі і часі. Доведено теоретичну недолугість використання категорії "ринок землі" в законодавчій та виконавчій діяльності держави. Розкрито правила та державні обмеження з укладання майнових договорів з оренди, концесії та купівлі-продажу. Обгрунтовано економічні та інституційні обмеження реалізації прав власності на землі сільськогосподарського призначення та запропоновано методологічні підходи до управління земельними ресурсами з огляду на глобальні виклики та загострення боротьби за обмежені ресурси на планеті Земля.

LAND RESOURCES MANAGEMENT OF UKRAINE: PAST AND FUTURE

Summary

By applying the principles of methodology of unity of historical and logical, macroeconomic and institutional analysis of factors of production, have been revealed theoretical limitations and practical inability of the introduction of the "land market" in Ukraine. Land as a factor of production and as a commodity is characterized by the following specific properties in comparison with other commodities: tendencies of diminishing supply and catastrophic growth in demand, non-renewability, inability to move in space and time. The theoretical inappropriateness of using the category "land market" in the legislative and executive activities of the state has been proved.
The analysis of the evolution of agrarian relations in the territory of Ukraine from the era of Trillian culture to the present allows us to conclude that, as a whole, the peasantry never owned the right of private land ownership in the classical interpretation of this phenomenon. In addition, in order to create for each citizen the features of an economical, entrepreneurial and rational personality, it is necessary to mobilize all the efforts of the state government and society as a whole in order to create a competitive environment, the rule of law and the protection of private property rights.
The experience of developed countries clearly indicates that the introduction of market circulation of agricultural land should be preceded by the creation of appropriate favorable conditions, especially in the issues of balanced taxation, effective market mechanisms of state support for agrarian entrepreneurship, mortgage lending, the formation of market infrastructure prevention of monopoly manifestations, significant restriction of the shadow economy in the agrarian sector, insurance of agricultural risks.
Underestimation of the specifics of the institutional environment and macroeconomic situation in Ukraine has led to a blurring of property rights and political confrontation between oligarchic and clan influence groups for the appropriation of land, without realizing its specificity as a commodity, as a strategic resource of national economic security, as a factor sources of family existence and safety in the long term. Legalization and liberalization of the land market in Ukraine, taking into account global trends, will lead, in our view, to a catastrophic increase in land prices. At the same time, at the initial stage of the land market, domestic monopoly-financial groups will have a major impact on the pricing process within the country, which will deliberately keep a low price not only on raw materials, but also on the cost of labor of employees, and especially on agricultural land. The paradigm of agricultural land management on the basis of lease and personification of land ownership in Ukraine is offered, which is confirmed by a comparative analysis of world practices and current global trends by aggravation of intercountry competition for all types of resources. It is justified economic and institutional constraints on the realization of agricultural land ownership rights are substantiated and methodological approaches to land management are proposed in view of global challenges and the intensification of the struggle for scarce resources on planet Earth.
