ЕКОНОМІКО-ПРАВОВІ ОСНОВИ РОЗВИТКУ СІЛЬСЬКОГОСПОДАРСЬКОЇ КООПЕРАЦІЇ В УКРАЇНІ

Анотація

У статті проведено дослідження економіко-правових основ розвитку сільськогосподарської кооперації в Україні. У ході дослідження зазначено, що серед багатьох факторів розвитку сільськогосподарської сфери, особливо важливу роль відіграє кооперація. Кооперативи є інструментом об'єднання малими виробниками сільськогосподарської продукції власних ресурсів і здійснення спільних стратегій на ринках продукції, послуг і засобів виробництва.
Встановлено, що сільськогосподарські кооперативи ще не вичерпали свій потенціал і мають перспективи для зростання. Проаналізовано стан та тенденції розвитку кооперативних об'єднань в Україні та деяких європейських країнах. Визначено основні тенденції розвитку сільськогосподарської кооперації в Україні. Зазначено, що одним з ключових факторів, які гальмують розвиток сільськогосподарської кооперації, є недосконалість чинного законодавства, яким регулюється діяльність кооперативів, та його розпорошеність.
Досліджено нормативно-законодавчі аспекти діяльності сільськогосподарської кооперації в Україні. Проаналізовано та визначено шляхи подальшого розвитку сільськогосподарської кооперації на основі державної підтримки.
У підсумку зазначено, що одним з основних напрямів розвитку сільського господарства України є підтримка кооперативних утворень шляхом створення сприятливих економічних та правових умов для започаткування та організації діяльності, зокрема державної підтримки формування та поліпшення матеріально-технічної бази кооперативних формувань.

ECONOMIC AND LEGAL BASES OF THE DEVELOPMENT OF AGRICULTURAL COOPERATION IN UKRAINE

Summary

One of the main components of the Ukrainian economy is agriculture. Its effectiveness affects the socio-economic development of the regions and the country in general. Among many factors in the development of the agricultural sector cooperation plays a particularly important role.
Cooperatives are the tool for bringing together small producers of agricultural products on their own resources and implementing common strategies in the markets for products, services and means of production.
Domestic and international experience demonstrates the ability of cooperatives to increase productivity, financial stability of the enterprise, as well as the ability to reduce transaction costs. Thus, in particular, agricultural cooperation affects positively on the updating and modernization of the material and technical base of the agricultural sector, allows to increase employment, promote the development of rural territories, etc. Currently both, large business entities and small businesses are involved in the cooperative movement, which makes it possible to increase their competitive position.
Circumstances that are pointed out determine the necessity of deeper scientific and practical exploration of the principles and circumstances of the formation and development of agricultural cooperatives, indicate the relevance and form the purpose of the study.
The economic and legal foundations of agricultural cooperation in Ukraine are investigated in the article. During the research it was stated that among many factors of agricultural development cooperation plays a specifically important role. Cooperatives are a tool for association small producers of agricultural products on their own resources and implementing common strategies in the markets for products, services and means of production. It is established that agricultural cooperatives have not yet exhausted their potential and have prospects for growth.
The condition and tendencies of development of cooperative associations in Ukraine and some European countries are analyzed. The basic tendencies of development of agricultural cooperation in Ukraine are determined.
It is pointed out that one of the key factors that intrude the development of agricultural cooperatives is the imperfection of the current legislation that regulate the activities of cooperatives and its proliferation.
The regulatory and legislative aspects of the activity of agricultural cooperatives in Ukraine are investigated. Ways of further development of agricultural cooperation based on state support are analyzed and identified.
As a result it is stated that one of the main directions of development of Ukrainian agriculture is the support of cooperative formations by creating favorable economic and legal conditions for starting and organizing activities, in particular, state support for the formation and improvement of material and technical base of cooperative formations.
