ПРАВОВІ ЗАСАДИ ДЕРЖАВНОГО РЕГУЛЮВАННЯ ДІЯЛЬНОСТІ ЗАКЛАДІВ ОСВІТИ

Анотація

Досліджено ключові нормативи державного регулювання діяльності закладів освіти. Визначено принципи ліцензування освітньої діяльності закладів освіти. Сформовано функції Міністерства освіти та науки України з приводу ліцензування освітньої діяльності на основі аналізу повноважень та їх узагальнення. Побудовано модель державного регулювання освітньої діяльності, яка показує і дозволяє аналізувати зміну статусу закладу освіти за етапами отримання ліцензії, можливі дії щодо ліцензії та умови на яких вона видається. Модель розкриває напрями регулюючого впливу органу ліцензування на процеси та суб'єктів, пов'язаних із отриманням закладами освіти ліцензій на провадження освітньої діяльності. Розглянуто особливості отримання ліцензії закладом освіти, проаналізовано механізми апеляційних звернень, анулювання ліцензії, вказано на їх причини та наслідки для закладу освіти.

LEGAL PRINCIPLES OF STATE REGULATION OF EDUCATIONAL INSTITUTIONS

Summary

The key norms of state regulation of activity of educational institutions are investigated. The principles of licensing of educational activity of educational institutions are defined. A state institution licensing education has been identified. The functions of the Ministry of Education and Science of Ukraine concerning the licensing of educational activities based on the analysis of its powers and their generalization have been formed. Requirements for business entities planning to carry out educational activities have been established. The rules for introducing changes to the license conditions are summarized and the minimum time intervals for preparing educational institutions to fulfill the new conditions are shown. It is determined that under the changes the legislator also understands the changes in the list of documents that the educational institution should submit to the licensing authority regarding the licensing processes and the preparation of new documentation should also be given time. A model of state regulation of educational activity has been constructed, which shows and allows to analyze the change of the status of an educational institution by the stages of obtaining a license, the possible actions for the license and the conditions on which it is issued. The model reveals the directions of the regulatory influence of the licensing authority on the processes and entities associated with obtaining educational licenses for educational activities. The peculiarities of obtaining a license by an educational institution are considered, the mechanisms of appeal appeals are analyzed, licenses are annulled, their causes and consequences for an educational institution are indicated. The powers of the expert-appellate council on licensing issues in the process of examining complaints during the licensing of educational activities and in case of revocation of a license are analyzed. The influence of the decisions of the board on the decisions of the licensing authority is shown. It is determined that the state regulatory policy in the part of state regulation of the activity of educational institutions is an instrument of achievement of the principles of state policy. The authority of the licensing authority in carrying out routine and unscheduled inspections of fulfillment of licensing conditions by an educational institution is shown. Reasons for unscheduled inspections are given.
